New York Aggravated DUI/DWI Penalties
Drivers face serious consequences when convicted for DWI/DUI in New York. However, those consequences are augmented when the driver is convicted for drunk driving with a high BAC. Under New York drunk driving laws, a conviction for aggravated DUI/DWI can result in the following penalties:
- Up to a one-year jail term
- A fine between $1,000 and $2,500
- Up to three years of probation
- Mandatory installation of an ignition interlock device (and related expenses)

- Annual driver assessment fee of $250 per year for three years
- Mandatory surcharges/court fees of $395
