New York Enhances Penalties for Cell Phone Violations
New York is tough on violators of its cell phone laws. Effective July 12, 2011, New York law increased the penalty for using a hand-held cell phone, smart phone or other electronic device while driving. Penalties for a cell phone violation in New York could include:
- Fine of up to $150
- Mandatory surcharges and fees of $85
- Three traffic penalty points added to your driving record
With the exception of using an attached GPS device (or other affixed device) or calling for emergency help, you could be ticketed for ANY use of an electronic device, including holding a cell phone or other device while composing, sending or viewing e-mails or text messages, sending or viewing pictures, accessing or surfing the Internet, playing games or otherwise using a cell phone, smart phone, laptop or other electronic device.
New York Vehicle and Traffic Laws (VTL) containing cell phone and texting restrictions include VTL 1225-c (Use of Mobile Telephone) and VTL 1225-d (Use of Portable Electronic Devices).
