Drug Trafficking

Drug trafficking is possession or distribution of large quantities of illegal substances. Article 220 of the New York Penal Code labels it as a crime. The difference between trafficking and possession lies in the volume of drugs involved in trafficking.

Major Drug Traffickers

New York identifies major drug traffickers under three categories:

  1. One who acts as a director of a controlled substance organization during any one-year period, wherein the organization sells at least one controlled substance and the proceeds from the sale(s) total $75,000 or more.
  2. A profiteer who knowingly and illegally sells a narcotic drug at least once within six months and yields a profit of $75,000 or more.
  3. A profiteer who knowingly and illegally possesses a narcotic drug with intent to sell the same at least once within six months and the drug(s) has a total value of $75,000 or more.

Penalties and Fines for Drug Trafficking

New York categorizes all convictions for drug trafficking as well as distribution of controlled substance as felonies. Convictions range from fifth-degree, punishable by 1 to 2.5 years in state prison for a first-time offender, to first-degree, liable to a minimum of 8 to 20 years in jail. Second time offenders are punishable by 12 to 20 years in prison. Major traffickers are liable for a maximum term of life imprisonment.

Fines generally range from a minimum of $5,000 up to $100,000 for individuals convicted of first-degree sale or operating as a drug trafficker. Felony offender fines range from a minimum of $5,000 or double the defendant’s gain from the sale, up to $100,000 for persons convicted of first-degree sale of a controlled substance or operating as a drug trafficker.
